Terms of Service

Effective date: 16 March 2026

These Terms of Service ("Terms") govern your use of ksbplanner.co.uk ("the Service"), operated by KSB Planner ("we", "us", "our"). By creating an account or purchasing any product you agree to these Terms in full. If you do not agree, please do not use the Service.

1. What the Service Is

KSB Planner is an AI-powered planning tool that generates apprenticeship delivery guides based on officially published data from:

  • Skills England — apprenticeship standard specifications, KSBs, duties, and EPA assessment plans
  • Ofsted FE & Skills Inspection Toolkit — inspection criteria and quality descriptors
  • DfE Apprenticeship Funding Rules — compliance requirements for funded delivery

The Service produces planning resources to support curriculum design. It does not provide legal, regulatory, or professional advice.

2. Use of Artificial Intelligence

All delivery guide content is generated by AI language models. We believe in full transparency about the technology we use:

  • Prebuilt sections (KSB interpretations, EPA preparation, delivery model, etc.) are generated using claude-sonnet-4-6
  • Customisable sections (curriculum sequence, OTJ allocation, progress milestones, etc.) are generated using gpt-5-mini-2025-08-07
  • Quality audits are performed using gpt-5.4-2026-03-05

AI models can produce errors, omissions, or inaccuracies. While we apply compliance guardrails, automated auditing, and quality checks, no AI system is infallible. We may update the models we use at any time to improve quality.

3. Your Responsibility

This is the most important section of these Terms. By using the Service, you accept full responsibility for reviewing, adapting, and validating all generated content before putting it into operational use.

In particular, you acknowledge that:

  • Generated content is a starting point for professional curriculum design, not a finished product
  • Use of our content does not guarantee any particular Ofsted inspection outcome or regulatory result
  • You must check all content against the current version of the apprenticeship standard, funding rules, and your own organisation's policies
  • Funding rules, inspection frameworks, and standards are updated periodically by their respective bodies — generated content reflects the data available at the time of generation
  • You are responsible for ensuring content is appropriate for your specific learner cohort, employer context, and delivery model

4. Products & Pricing

We offer two tiers:

  • Basic Guide (£14.99) — 8 prebuilt sections per standard
  • Full Pack (£29.99) — all 8 prebuilt + 9 customisable sections with user-configured inputs

Prices are in GBP and inclusive of VAT where applicable. We reserve the right to change pricing at any time; changes will not affect existing purchases.

5. Refunds & Cancellations

Our products are digital content delivered immediately upon purchase. By completing a purchase, you consent to immediate delivery and acknowledge that you lose your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

All sales are final. We do not offer refunds once content has been generated or accessed. If you experience a genuine technical issue preventing you from accessing your purchased content, please contact us and we will do our best to resolve it.

6. Intellectual Property

Upon purchase, you receive a non-exclusive, non-transferable licence to use the generated content for your own internal training delivery purposes. You may:

  • Print, share with colleagues, and adapt the content for your own programmes
  • Use the content across multiple cohorts within your organisation

You may not:

  • Resell, redistribute, or sublicense the generated content to third parties
  • Publish the content publicly or make it available for download by others
  • Claim the generated content as an official or regulator-issued document

The underlying apprenticeship standard data is Crown copyright and published by Skills England under the Open Government Licence v3.0.

7. Accuracy & Limitations

We take reasonable steps to ensure generated content is accurate and compliant, including automated quality audits and compliance guardrails. However:

  • Content is generated based on the standard version and regulatory data available at the time of generation
  • We do not guarantee that content is error-free, complete, or suitable for any specific purpose
  • Regulatory bodies (DfE, Ofsted, IfATE/Skills England) may update their requirements at any time — it is your responsibility to check for changes
  • We are not a training provider, awarding body, or regulatory authority

8. Accounts

You must create an account to purchase content. You are responsible for maintaining the security of your account credentials. Each account is for a single user; do not share login details.

We may suspend or terminate accounts that violate these Terms or are used fraudulently.

9. Payments

All payments are processed securely by Stripe. We do not store your card details. By making a purchase you also agree to Stripe's terms of service.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or generated content
  • Our total liability for any claim arising from a purchase shall not exceed the amount you paid for that specific order
  • We are not liable for any decisions you make, or outcomes you experience, based on generated content — including but not limited to Ofsted inspection grades, funding audit outcomes, or contractual disputes with employers

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

11. Data & Privacy

We process personal data in accordance with our Privacy Policy. Your data is stored on servers located in the EU (London, UK) for GDPR compliance.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
